Terms of Service
Last updated: 7 October 2026
These Terms of Service (“Terms”) govern your use of FairThen (“FairThen”, “the app”, “the service”, “we”, “us”, or “our”). By downloading, accessing, or using FairThen, you agree to these Terms, and when you create an account we ask you to confirm that by ticking a box as you finish setting it up. If you do not agree, do not use the app.
1. The most important thing
FairThen is a calculator and record-keeper, not a payment service, bank, money transmitter, or financial institution. It helps you track who owes what and suggests how to settle up. It does not move, hold, or transfer money. Any actual payments happen directly between you and other people, through whatever method you choose, entirely outside FairThen. We are not a party to those payments and are not responsible for them.
2. Who you’re dealing with
FairThen is made and operated by Pandoma PLT, a limited liability partnership registered in Malaysia, registration no. 202604002010 (LLP0047250-LGN). Registered office: 10-1st, Persiaran Seksyen 4/8, Bandar Putra Bertam, 13200 Kepala Batas, Pulau Pinang, Malaysia.
For anything at all, including questions, complaints, or claims, email support@fairthen.com. There’s also a support page that answers most things faster than we can.
3. Beta software
FairThen is in Public Beta. That means it is a work in progress: features may change, break, or disappear, data loss is possible, and downtime can happen. The service is provided “as is” and “as available,” with all faults and without warranties of any kind. Don’t rely on FairThen as your only record of anything important.
4. Your account & your responsibility
- You must provide accurate information and keep your login credentials secure.
- You are responsible for all activity under your account.
- You are solely responsible for the accuracy of the expenses, amounts, splits, and balances you create, and for any decisions or payments made based on them.
- You are responsible for any personal information you enter about other people and for having the right to enter it.
- You must be old enough to form a binding contract in your country, and at least 13, or older where the law where you live sets a higher minimum age for using online services on your own. In parts of Europe that’s 14, 15, or 16.
5. Acceptable use
You agree not to:
- use FairThen for anything unlawful, fraudulent, or harmful;
- upload content you don’t have the right to upload, or that is illegal, infringing, hateful, threatening, sexually explicit, or otherwise objectionable;
- attempt to break, overload, reverse-engineer, or gain unauthorised access to the service;
- use FairThen to harass others or violate their rights.
If content or an account breaks these rules, or we have to act for legal or security reasons, we may remove the content, or suspend or close the account. We’ll tell you why and give reasonable notice unless the situation is urgent or telling you would be unlawful.
6. Reporting something
If you come across content in FairThen that you think is illegal, infringes your rights, or breaks the rules in section 5, please report it. Email support@fairthen.com, or start from the support page, which is the same route we use for every other kind of support request. Tell us what the content is, where you found it, and why you think it’s a problem, and give us a way to reach you. We read every report and act where it’s warranted, and we’ll tell you what we decided.
7. Price
FairThen is free, and there is nothing to buy. We don’t sell anything in the app, we take no payment details, and every feature in it is free to use. If that ever changes, we’ll update these Terms before anything goes on sale, and you’d always choose whether to pay.
8. Intellectual property
FairThen, its name, design, and software are owned by Pandoma PLT. You get a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. The content you create remains yours; you just grant us the limited permission needed to store, process, and sync it so the app can function.
9. No warranty
To the maximum extent permitted by law, FairThen is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure, that calculations will be free of mistakes, or that the AI features will produce accurate results, however you choose to run them. You are responsible for reviewing and verifying anything an AI produced, and any figures, before relying on them.
10. Your own AI key & on-device AI
FairThen’s AI features can be run without us in the middle. In Settings → Advanced you can add your own API key for a third-party AI provider, in which case the app calls that provider directly from your device, or you can point it at an endpoint you control, and, as on-device models become available in the app, at one running on the phone itself. Unless the app tells you otherwise at the point you use a feature, those requests don’t touch our servers and don’t touch our providers. Before the first scan with each provider, the app asks you, and names the provider.
- Your key, your account, your bill. The provider charges you directly, at their prices, under whatever you agreed with them. We don’t see that bill, can’t refund it, and can’t cancel it for you.
- Their rules apply too. Pointing FairThen at a provider’s API means keeping to that provider’s terms and acceptable-use policy as well as these Terms. We can’t give you access on terms you don’t already have.
- Look after the key. The key stays on your device, in the device’s secure credential storage, so keeping it safe is your job. The app will only send it to an encrypted (https) endpoint, but the rest is on you: use a key with a spending limit if the provider offers one, and revoke it if you think it has got out. If someone gets hold of it and runs up charges, that’s between you and the provider.
- We don’t control the result. The provider’s models, prices, rate limits, availability, and privacy settings are theirs to change, and a model running on your own hardware performs as that hardware allows. Accuracy, speed, and whether a request works at all can all vary, section 9 applies to every bit of it, and we can’t debug or fix something happening on someone else’s service. Check what comes back either way.
- It changes the AI step, not the app. The reading moves to your provider. Everything else works as it always did, so anything you go on to save is stored and synced like any other data you add, under these Terms and the Privacy Policy.
- It’s how the AI features run. We don’t host AI for you at the moment, so your own key or your own device is the way to use them, at no cost from us.
- What we support may change. Which providers and models work with this can change as they come and go, sometimes because a provider retires something with no notice to us. We’ll tell you where we can.
When you use your own key or your own device, we are not the ones reading that receipt, and are not responsible for what the provider does with what you send. Section 5 of the Privacy Policy sets out what that means for your data.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, money, profits, or goodwill, arising from your use of (or inability to use) FairThen, including any disputes between you and the people you split with, or any reliance on amounts or balances shown in the app. Where liability cannot be excluded, it is limited to the greater of the amount you paid for FairThen in the past 12 months, or $10.
None of that applies to things the law doesn’t let us limit. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that can’t lawfully be excluded, including consumer guarantees you have under the law where you live.
12. Disputes between users
Any disagreement about who owes whom, whether someone paid you back, or how a bill should be split is strictly between you and the other people involved. FairThen just shows the numbers you and they entered. We are not a mediator, escrow, or guarantor.
13. Indemnity
If someone else brings a claim against us over something you uploaded, something you did, or your breach of these Terms or the law, you agree to cover our reasonable, direct costs of dealing with it. That’s limited to what a court would consider fair, it doesn’t apply to the extent the problem was our fault, and it doesn’t apply at all where consumer law says it can’t.
14. Ending things
You can stop using FairThen and delete your account at any time (see Delete your account). We may suspend or close an account for the reasons in section 5, and we may discontinue FairThen entirely, including if running it stops being viable. Where we can, we’ll give notice and time to export your data first.
15. Changes to these Terms
We may update these Terms as the app evolves. Material changes are signalled by updating the “Last updated” date above, and we’ll flag significant ones in the app where we can. Continued use after a change means you accept the revised Terms.
16. If you got the app from the Apple App Store
Apple requires us to say the following, and it only applies to the iOS app:
- These Terms are between you and Pandoma PLT only, not with Apple. We, not Apple, are responsible for FairThen and its content.
- Your licence to use FairThen is limited to Apple-branded devices you own or control, as set out in the Apple Media Services Usage Rules.
- Apple has no obligation to provide any maintenance or support for FairThen. That’s on us.
- If FairThen fails to conform to any warranty, you can tell Apple and Apple will refund the purchase price. Beyond that, Apple has no warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses are our responsibility.
- We, not Apple, are responsible for any claim that FairThen or your use of it doesn’t comply with the law, doesn’t meet a legal or regulatory requirement, or breaches consumer protection or privacy law, and for any product liability claim.
- We, not Apple, are responsible for handling any third-party claim that FairThen infringes intellectual property rights.
- You confirm you are not in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and are not on any US Government list of prohibited or restricted parties.
- You must also comply with any applicable third-party terms, for example your mobile data plan.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Questions, complaints, or claims about FairThen go to Pandoma PLT at the address and email in section 2.
17. Governing law & where disputes go
These Terms are governed by the laws of Malaysia, and the courts of Malaysia have non-exclusive jurisdiction over any dispute.
That doesn’t take away your local rights. If you’re a consumer, you keep the protection of the mandatory laws of the country you live in, and you can bring a claim in your local courts where that country’s law says you can. For Malaysian consumers, nothing here affects your rights under the Consumer Protection Act 1999, including your right to bring a claim before the Tribunal for Consumer Claims.
We’d always rather sort a problem out directly and in good faith, so please email us before anything escalates. It usually works.
18. General
- Severability. If any part of these Terms is found unenforceable, the rest still applies.
- Entire agreement. These Terms are the whole agreement between you and us about FairThen. The Privacy Policy explains how we handle your data.
- Assignment. You can’t transfer your rights under these Terms. We may transfer ours if FairThen is merged, acquired, restructured, or sold, and we’ll tell you if that happens. Your rights under these Terms stay the same.
- No waiver. If we don’t enforce something straight away, we haven’t given up the right to enforce it later.
- Things outside our control. We’re not liable for failures caused by events we can’t reasonably control, like outages at our infrastructure providers, natural disasters, or new legal restrictions.
- Survival. Sections 1, 8, 9, 10, 11, 12, 13, 17, and this one survive after you stop using FairThen.
